In the event of a defect in material or workmanship within 90 days from the date of original purchase, First Act Inc. (“First Act”) will repair or replace this product with the same or comparable model. This warranty is applicable to the original purchaser only and is applicable only when purchased from an authorized reseller in the USA, Canada, or Puerto Rico. This warranty gives you specific legal rights; you may also have other rights which vary from state to state. This is the only express warranty applicable to this product. First Act neither assumes nor authorizes anyone to assume for it any other express warranty. Failure to register your First Act product does not diminish your warranty rights.
This warranty does not apply to parts that are subject to normal wear and tear such as reeds, corks, felts, pads, guitar strings, pick guards, drumheads and drum sticks. This warranty also does not apply to damage occurring in shipping, handling, abuse or neglect, deterioration by reason of perspiration, corrosive atmosphere, or other external causes such as extremes in temperature or humidity, modifications, scratches or discoloration, accidents or acts of God.
First Act will, at its option, repair or replace a defective product covered by this warranty without charge for labor or materials. Repairs may be performed using new or refurbished parts that meet or exceed First Act specifications for new parts. If First Act elects to replace the product, the replacement may be a reconditioned unit. You will be responsible for any initial shipping charges if the product(s) must be shipped for warranty service; however, First Act will pay the return shipping charges to any destination within the USA if repairs are covered by the warranty. This warranty does not cover: (a) damage, deterioration or malfunction resulting from accident, negligence, misuse, abuse, operation or failure to follow instructions contained in any written materials that accompany this product; (b) any shipment of the product (claims must be presented to the carrier); (c) repair or attempted repair by anyone other than First Act or an authorized First Act Service Center; or (d) any product which has been altered or on which the serial number has been defaced, modified or removed. Altering, erasing, or forging any proof-of-purchase documents voids any applicable product warranty. If any product submitted for warranty service is found to be ineligible, an estimate of repair cost will be furnished and the repair performed only if requested by the owner and upon receipt of payment or acceptable arrangements for payment.
Limitation of implied warranties and exclusion of damages:
First Act shall not be responsible for incidental or consequential damages or for damages based upon inconvenience, loss of use, damage to any other equipment or other items at the site of use. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. First Act’s liability for any defective product is limited to repair or replacement of the product, at First Act’s option.
